Baby Picture Icon Sues Photographers for Exploiting Him

( – Nirvana’s “Nevermind” album cover is arguably one of the most iconic of all time. It featured a naked baby, submerged in water, floating near a dollar bill attached to a fishhook. That baby grew up into a man and now he’s suing the band.

Lawyers for Spencer Eldon, 30, filed a lawsuit on August 24 in US District Court in California. The plaintiffs listed include Kurt Cobain’s estate, the living members of the band and others. Attorneys claim Eldon suffered “lifelong damage” from the album cover. The suit accuses the parties of intentionally marketing child pornography to “promote themselves and their music” at Eldon’s expense.

The lawsuit also claims the band promised to cover his genitals on the album cover and claims they forced him to engage in “commercial sex acts.” The attorney claims Eldon never received compensation and his guardians never signed a release. However, in the past, his parents have said they received $200 for the photo.

Over the years, Eldon has recreated the album cover. The most recent time was in 2016 to celebrate its 25th anniversary. The same year, he sat down for an interview discussing how the photo impacted his life. He said it’s strange that so many people have seen him naked, but “it’s cool to be a part of that recipe for success,” and he went on to say, “it’s not that big of a deal.”

Eldon is asking for $150,000 from each of the plaintiffs.
