Child Confesses to 2022 Murder: No Charges Due to Age

Nixon, Texas – A 10-year-old boy in South Texas is being questioned for allegedly threatening to kill a classmate. Shockingly, during the investigation, the child confessed to killing a man two years ago. According to law enforcement officials, the child cannot be charged for the crime due to state laws.

The incident unfolded in the Nixon-Smiley Consolidated Independent School District, where the unidentified child revealed to school officials that he had shot and killed a man in 2022. The Gonzales County Sheriff’s Office disclosed that the child shared details about the shooting death of 32-year-old Brandon O’Quinn Rasberry in Nixon, Texas, which is located an hour east of San Antonio.

The child recounted being at an RV park visiting his grandfather, who lived near Rasberry. He admitted to taking a pistol from his grandfather’s truck, entering Rasberry’s RV, and fatally shooting him. The child claimed he had no prior relationship with Rasberry, stating he saw him walking around the RV earlier that day.

Investigators discovered the murder weapon at a pawn shop in a nearby town and linked shell casings to the crime scene. However, because the child was under 10 years old at the time of the homicide, he cannot face charges under Texas law. Jonathan Fojtik, the victim’s brother, expressed disbelief at the tragic revelation, describing Brandon as a kind-hearted individual who would help anyone in need.

Although the child cannot be prosecuted for the 2022 murder, he has been charged in connection to the recent threat against his classmate. Currently, he is in juvenile detention awaiting a court appearance, as authorities navigate this complex and heartbreaking case.
