The company has voiced its grievances regarding AI-generated videos featuring popular characters from its franchises, including Superman and Batman, as well as figures from the Marvel universe and other major properties.
In a cease-and-desist letter dispatched to ByteDance on Tuesday, Wayne M. Smith, Warner Bros. Discovery’s legal chief, emphasized the significance of the studio’s intellectual property. He pointed out that ByteDance’s Global General Counsel, John Rogovin, should be acutely aware of the protection and value placed on these beloved characters, given his previous tenure at Warner Bros.
Smith highlighted the irony in ByteDance’s current situation, noting that the company is now allegedly infringing on properties that Rogovin once helped safeguard during his time with Warner Bros. He underscored that these iconic characters represent the very essence of the company’s legacy and ongoing efforts in film and entertainment.
The legal threats come at a time when various organizations, including the Creative Artists Agency (CAA) and the Motion Picture Association (MPA), have rallied together against the surge of AI-generated content that juxtaposes characters from competing franchises. This collaboration closely coincides with ongoing contract negotiations involving several industry guilds, such as SAG-AFTRA.
In response to heightened scrutiny, ByteDance has indicated its commitment to strengthening safeguards against the unauthorized use of intellectual property.
