Kennedy faced backlash after a fundraising email portrayed the rioters as “activists” who had been unjustly deprived of their constitutional rights. His campaign clarified that the statement was an error made by a new marketing contractor and terminated the contract with the vendor.
In his subsequent statements, Kennedy continued to express doubts about the prosecution of the January 6th defendants, questioning whether political motives influenced the severity of the charges. He highlighted the lack of evidence for a true insurrection, citing that the protestors were unarmed and that Trump had urged them to protest peacefully.
