An investigation in Talbott, Tennessee has uncovered a factory’s illegal employment of immigrant teenagers in unsafe conditions, resulting in a hefty financial penalty of nearly $2 million. Tuff Torq factory, specializing in manufacturing lawn mower parts, was found to have ten children working in oppressive child labor, prompting action from the Labor Department.
Labor Department Wage and Hour Division Administrator Jessica Looman emphasized the dangers of exposing children to hazardous work environments, stating that even one child working in such conditions is unacceptable. The factory was fined $296,000 for violations that included underage children operating dangerous machinery, as observed by investigators during their probe.
In addition to the fine, Tuff Torq has been mandated to allocate $1.5 million for the benefit of the illegally employed children at the facility. This financial disgorgement represents 30 days’ worth of profit for the company as a consequence for their actions. The company must take immediate steps to cease the illegal employment of children to ensure the safety of all workers.
Solicitor of Labor Seema Nanda highlighted the importance of holding companies like Tuff Torq accountable for their actions to deter future violations and protect vulnerable individuals in the workforce. By disgorging profits for the benefit of the children, the agreement aims to make victims whole while sending a clear message that endangering children in the workplace has significant financial repercussions.
Tuff Torq’s legal representation has claimed that underage employees were temporary workers hired through a third-party staffing company, allegedly using falsified identities. The company stresses its commitment to ethical labor practices and fair treatment of workers, showcasing efforts to enhance training and compliance programs to prevent similar incidents in the future.
With Japanese firm Yanmar as the majority owner, Tuff Torq produces lawn mower parts utilized by various companies, including John Deere. The consequences of the factory’s actions serve as a reminder of the importance of upholding ethical labor standards and ensuring the safety and well-being of all workers, especially vulnerable populations like underage employees.
