Atlanta, Georgia – In a recent development in the criminal case against former President Donald Trump and his co-defendants, Fulton County Superior Judge Scott McAfee has dismissed some charges against them. The ruling by Judge McAfee leaves most of the charges in the racketeering indictment intact.
McAfee’s decision came after he ruled that certain charges related to the alleged solicitation of violation of oath by a public officer lacked essential details about the underlying crime being solicited. While acknowledging that the state had alleged plenty of conduct by the defendants, McAfee found the lack of detail about an essential legal element to be fatal.
Despite throwing out the solicitation charge, McAfee noted that the conduct forming the basis of that charge could still be used by prosecutors in the larger racketeering charge, which is central to the case in Georgia. He clarified that the dismissal of certain charges did not mean the entire indictment was dismissed.
The judge did not address the ethics allegations against Fulton County District Attorney Fani Willis brought by the defendants. McAfee indicated that he would issue a ruling on the ethics issue by the end of the week.
